As of Thursday evening, Gary Alberts’ dog, Buffy, is no longer a dangerous dog, according to police.
The dog had been declared dangerous by the Portage Police Department. That declaration was overturned on a 5-4 vote by the Common Council last week.
The 6-year-old American Water Spaniel received the declaration after biting a young girl in the leg. The girl needed numerous stitches from the injury.
A motion before the Legislative and Regulatory Committee to uphold the declaration, which comes with a number of fencing, license and insurance requirements if the dog is to be kept by Alberts, failed 2-2 at a meeting earlier this month.
Alberts appealed the declaration, saying that the dog was tethered on his property and that the girl was on his property without his permission while he was away from his home.
