Dog involved in yorkie attack euthanized, but legal action may follow – Las Vegas MyNews3 – KSNV

A dog that attacked and killed a Yorkie over the weekend in Red Rock Country Club has been euthanized.

The dog’s owner says the 12-year-old Malinois was put down hours after the attack. Both dog owners say they are gearing up for a legal battle.

The Malinois was put down after she mauled a Yorkie owned by neighbor Maria Santos on Saturday. The large dog was one of two that escaped from Robert Lazenby’s nearby home.

He says he was out of country when the attack happened, and that his older children were caring for the dogs.

Lazenby said the pets got out when the wind blew a gate open. Local attorneys say Santos has a right to sue for negligence.

“If the homeowner fails to latch the door, if the homeowner doesn’t have a fence, if the homeowner doesn’t have an electronic fence for the dog or there isn’t precautions in place, then there’s an argument to be made, that the homeowner was negligent,” said attorney Joshua Tomsheck.

For Santos, a lawsuit won’t bring back her beloved dog Trixie, who she says she loved like a child.

The county club says even though the dog was put down, its investigation isn’t closed yet.

There could be legal consequences for the owner because the dog was out loose.

Even though it wasn’t intended the attacking dog got out which then set into action a course of events that resulted in Ms Santos dog being killed.The attacking dogs owners is liable plain and simple.Not buying it that the wind blew the gate open.If it did must have one hell of a windy day or a real shoddy crappy gate + fence(more like it was left open) . I’ve had properly latched gates with stand 70mph winds during a tropical storm.
