Jack Russell owner had to punch 30kg Bull Mastiff on head after huge dog went went “ballistic”, court told – Huddersfield Examiner

A woman has been ordered to pay compensation after her pet attacked a dog before turning on its owner.

The huge Bull Mastiff cross escaped from its Almondbury home after ‘going ballistic’ at the sight of the Jack Russell.

Owner Rita Darby admitted that she could not control the 30kg animal, despite having two children living in her house.

The dog has since been destroyed, Kirklees Magistrates Court heard.

Darby, of Highcroft Crescent, pleaded guilty to being the owner of a dog which was dangerously out of control and caused injury.

The offence happened on June 13 outside Darby’s home.

At 2.35pm Frederick Muxlow was walking by with his dog on a lead together with his partner and three children.

As they walked past the 45-year-old’s house Mr Muxlow saw the large muscular dog run out of garden and head towards them.

Alex Bozman, prosecuting, said: “It attacked Mr Muxlow’s dog by biting its rear leg and was growling very aggressively.

“He had to stand on the dog’s head because it had his dog’s legs in its mouth.

“The Jack Russell was able to break free from its jaws.

“At that point the Bull Mastiff directed its attention to Mr Muxlow.”

The court heard that he was bitten on his arm and leg, the puncture wound to his arm causing it to bleed.

Mr Muxlow punched the dog on its head, which shocked it and it ran back into its home.

In her police interview Darby said that she had left the dog indoors but hadn’t shut the door properly.

She said that she got the dog as a puppy but for the last six months felt it had become much stronger.

The dog was kept in the back garden and when it was walked Darby described it as yanking her and pulling her in front of vehicles.

Mr Bozman said of Darby, who had children aged 12 and 16 living with her at the time of the attack: “She said it goes ballistic at other dogs.

“She can’t handle him and didn’t realise it was going to get this big.”

District Judge Michael Fanning told Darby that she needed to understand that dogs like hers are potentially lethal weapons.

He added: “I need to send a very clear signal that if you don’t control your dog you will pay a penalty for that.”

Darby must pay £100 compensation to Mr Muxlow.

She was also sentenced to a community order with 120 hours of unpaid work.
